These Terms of Service ("Terms") govern your access to and use of the Fuse platform and services provided by Fuse ("we," "our," or "us") at fusepro.app. By accessing or using our services, you agree to be bound by these Terms.

By creating an account, booking a demo, or using any Fuse service, you confirm that you have read, understood, and agree to these Terms. If you are using Fuse on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

6. Intellectual Property

Fuse retains all intellectual property rights in our platform, software, methodologies, and technology. You retain ownership of your data. The custom automations and workflows we build for you are licensed to you for use during your active subscription.

You grant Fuse a limited license to access your connected systems solely to provide the services you have requested.

7. Data and Confidentiality

We treat all client data as confidential. We will not disclose your data to third parties except as described in our Privacy Policy or as required to provide our services. We implement industry-standard security measures to protect your data.

As a mortgage service provider, we understand the sensitivity of borrower data. Any borrower PII accessed through integrations is processed under your instruction only and is not stored by Fuse beyond what is necessary to execute the automation.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.

FUSE'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

FUSE PROVIDES ITS SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Indemnification

You agree to indemnify and hold harmless Fuse and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.

12. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days written notice of any material changes via email. Your continued use of our services after the effective date of changes constitutes acceptance of the new Terms.
